The term 'Whitewater Contemporary' (Whitewater Contemporary is the trading name of Whitewater Gallery Limited) or 'us' or 'we' refers to the owner of the website whose registered office is 1 & 1a The Parade, Polzeath, Wadebridge, Cornwall. PL27 6SR. Our company registration number is No. 9531608 Registered in England and Wales. The term 'you' refers to the user or viewer of our website or social media.

 

Using our website or social media:

Paintings, sculptures and collectables ('Artworks') for sale are displayed online with approximate sizes. If you wish to verify framed or unframed sizes please ask.

 

Great care is taken to ensure that the images displayed online faithfully represent the Artworks for sale. However, as we cannot control how other display equipment reproduces images when you view our Artworks online the colours and shades may differ to the original.

 

All intellectual property rights for any Artworks remain with the artist ('Artist') who created them. Reproduction is not permitted without express permission from the Artist.

 

  • The content of the pages of this website is for your general information and use only. It is subject to change without notice.
  • This website uses cookies to monitor browsing preferences. If you do allow cookies to be used personal information may be stored by us for use by third parties to analyse the website performance only.

Reservation, purchase, passing of ownership & VAT:

Payment must be made in full prior to dispatch or collection.  Any delivery and packaging costs incurred will be agreed with you prior to payment being made.  Payment is accepted by Credit Card, Debit Card, Amex at point of sale or over the telephone.  Our online payment system is through an independent payment processing agency stripe.com

 

An Artwork may be reserved by agreement. A refundable deposit is taken to hold the piece for an agreed period.

 

All Artworks remain our property until full payment has been received.

 

On receipt of full payment, ownership and risk transfers to you.

 

Please note, VAT is only charged when our artist is VAT registered. For sales of work by artists not registered for VAT no VAT will be shown on your invoice and none can be reclaimed as input tax. A VAT invoice is avaiable upon request.

 

Shipping

The delivery charge is confirmed at the 'check out'. The average delivery time is 3-7 working days within the UK. We will advise the delivery date within 24 hours of the receipt of your order.

All other works are delivered free of charge in the UK.

 

Framed prints are often made to order and usually will be shipped within 7 working days using a next day courier fragile service. Please contact us if urgent delivery is needed as this can often be arranged.

 

We aim to dispatch items small items within two days of the receipt of an order, you will be informed if this is not possible. Your order should arrive within 5 working days of dispatch, please contact us if delivery is urgent or a particular day for delivery is preferred. Working days exclude weekends and public holidays.

 

The above items are sent via a tracked and signed for service which requires a signature, you may prefer to choose a delivery address where you know someone will be available to accept the delivery.

 

Original paintings and larger pieces are sent via a reputable specialist courier company and are delivered free of charge. Delivery should be within 3 weeks from receipt of order, unfortunately it is not possible to guarantee a particular day for delivery as van routes vary from week to week, but you will be informed and given options once we have made the booking with the courier. 

 

Remote Areas: 

Please allow extra time for your order to arrive if you live in a remote area.

 

Overseas Delivery

Delivery of all works can be arranged to most destinations using a specialist delivery company. Artworks can be ordered via the website and the delivery time and cost will be confirmed within 24 hours and an invoice sent for this amount which can be settled through Stripe, our website payment provider.

 

Duties and Taxes

International packages may incur taxes and/or duties, please familiarise yourself with your country's fees and policies before placing an order.

Whitewater Gallery Ltd will enter the full purchase value of orders on customs forms.

Receipt of Goods: 

On receipt of goods please check them thoroughly to ensure no damage has occurred during transit. Please do not accept or sign for anything before checking. 

 

If circumstances beyond our control delay the arrival of your order, we will endeavour to keep you informed by telephone or email.

 

Cancellations

We will try our best to fulfil every order as specified in our terms but delays and cancellations may occur for reasons beyond our control. We reserve the right to cancel any orders for any reason, refunding you for the full amount immediately. You may cancel your order with us, for any reason, provided you inform us before the item is despatched for delivery, with the exception of items that you have purchased but asked us to store for collection or to be shipped at a later date in which case cancellation must be notified in writing with in 30 days of our receipt of your payment. Upon our acknoledgement of your cancellation will endeavour to refund you immediately.

 

Returns Policy

 

Return of Items Purchased Online

Please think carefully about your purchase to ensure that you are making the right choice if in doubt please contact us by email or telephone before placing an order. 

 

If you are not entirely happy with your purchase you can return it to us immediately and receive a full refund. We must receive the returned artwork no later than 14 days after delivery to you.

 

Please note that earrings cannot be returned due to hygiene reasons. Custom orders cannot be refunded so please have in mind exactly what you require before ordering, this includes gemstone type and ring size. Rings with gemstones cannot be resized.

 

Before returning an artwork please either telephone or email your cancellation to art@whitewatercontemporary.co.uk including your name, invoice number, order date, email address, telephone number and reason for return. You must meet the cost of returning unwanted artwork and you will be responsible for any loss or damage to artwork you return to us. Artwork must be received by us in a fully resalable condition. If the item is to be returned by post, a 'signed for' delivery service is recommended.

 

We will process your refund within 10 days of receiving the returned Artwork and payment will be made directly to the debit or credit card you used for the original purchase. We are not able to offer a refund if you change your mind about Artwork which you have commissioned or one which has been specifically customised to your requirements (for example when we have framed a painting for you).

 

On receipt of your parcel if the packaging is damaged, please sign for it as damaged or refuse receipt, if the parcel is not returned please keep, and if possible photograph the damaged packaging.

 

Return of unwanted Artworks or gifts purchased in the gallery

We do not usually accept the return of Artworks once a sale has been completed. We reserve the right to offer you a credit note or an exchange in certain circumstances.

 

Unwanted gifts must be returned to the gallery in a fully saleable condition at the customers expense and a credit note, valid for one year, will be issue for the full purchase value of the artwork.

 

Damaged Goods:  

If goods have been damaged in transit please do not accept them.  Please return them with the courier and let us know immediately. Unfortunately, we cannot give any refunds if you accept the goods unchecked and then subsequently discover they are damaged.

If damaged goods are returned to us outside this arrangement they will be returned to the customer at the customer's expense.
